Alternative Dispute Resolution (ADR)

This website serves as a personal introduction to my being appointed as an arbitrator, an expert, a mediator or a conciliator. Arbitration, expert references (whether by expert adjudication or expert determination), mediation & conciliation, are often referred to together as alternative dispute resolution or ADR.

You may be considering an arbitration or other ADR appointment and therefore need to perform due diligence on myself as a possible appointee lawyer accountant arbitrator, lawyer accountant expert determiner, lawyer accountant adjudicator, lawyer accountant mediator, lawyer accountant conciliator. Such due diligence would include vouching qualifications, together with considering the interests and expertise of the potential appointees. Alternatively I may have already have been appointed as the arbitrator, expert determiner, adjudicator, mediator or conciliator, by an arbitral or similar institution; and you want to know more about my background. Specifically, disputes involving: accountancy, especially where knowledge of law and accountancy is required; insolvency; finance, possibly with an offshore or fund or asset management element; protected cell companies and insurance; asset-based lending; pensions; partnerships splits; alternative energy, especially wind energy; and friendly societies or co-operatives.

Good Standing

Professional bodies can provide a certificate of good standing, which will state that a member has been or maybe subject to in due course disciplinary action. Such certificates cost. I have in the past had a requirement to produce such certificates. These certificates are reproduced below. As noted on my qualification page, direct request can be made of these professional bodies by third parties. As to the ACCA qualification, I was previously an ACCA member, but resigned because I believed my position within the ICAEW may have created a conflict in that I was representing the ICAEW, but was a member of a competing accountancy body.

Publications

I have been involved in a number of publications: the more recent being with the publishers Spiramus and Jordans, details of which are noted below. My 'current project' is a book with the working title of "Dispute Resolution: Trustees and Fiduciaries", which is to be co-authored with Peter Pexton (http://gantengroup.com/en/our-team) and is due for publication in 2013. The book will focus on ADR techniques, especially mediation, within a trust context. The book is being published in conjunction with STEP (The Society of Trust & Estate Planners) who will be running a series of courses on the subject. Considering previously expressed views, especially written views, of a potential arbitrator is part of the arbitrator interviewing and selection process. I do not believe any of my publications express any view that would be considered of interest to potential appointors.
